Protect Your Parental Rights

Georgia places numerous legal rights and obligations on the parents of minor children. In Georgia, every parent is responsible for providing for his or her child. In addition, Georgia law presumes that a child is better off with both biological parents in his or her life. That means the court will look to a custody or visitation plan for which both parents can play an active role in the lives of their children.

However, these rights are only given to legally recognized parents. If your child was born out of wedlock and you are not listed on the birth certificate, you may not be able to see your child.

Legitimation May Help

Legitimation accomplishes multiple things, including:

  • Your child can inherit your property.
  • You can petition the court to obtain visitation or custody.
  • You can ask for child support from the noncustodial parent.
  • Your child’s school will recognize you as the parent.

The court will award legitimation if it is in the best interests of the child to do so. As long as it is in the best interests of the child, you may also be able to obtain custody or visitation rights by petitioning the court.

We Help Fathers Establish Parental Rights

At Tisdale Middleton & Land, we can help parents establish their parental rights through legitimation. Our legitimation attorneys will work diligently to help you obtain the rights you deserve under the law.

We Also Help Mothers Contesting Legitimation

If a court finds that a father has abandoned his opportunity interest to be a parent or it finds that the child’s best interest would not be served by legitimation, a father’s petition may be denied. Under appropriate circumstances, a mother may validly contest legitimation and still fight for child support. Tisdale Middleton & Land can help in that fight.
